Possession is a matter of proof of necessary oral and
documentary evidence. The Court has to investigate and
record finding as to who is in physical possession of the
dispute property. In the regard, the investigation by a local
Commissioner is not permissible. The position of law was
make clear by several precedents. The recent one to be
referred is Parepally Satyanarayana Vs., Vutukuri
Meeneder Goad 2008 (1) ALT 461 case. It is held that a
Commissioner cannot be appointed to find out as to who is in
occupation of the property.
