Criminal Case – Prosecution must have to prove beyond reasonable doubt. – Partap Vs. The State of Uttar Pradesh

In the judgment Partap v. The State of Uttar Pardesh, AIR 1976 Supreme Court 966 has reported that the burden is on the accused to establish a plea of self defence and that on the prosecution to prove its case. The burden on the accused is not as onerous as that which lies on the prosecution. While the prosecution is required to prove its case beyond a reasonable doubt, the accused can discharge his onus by establishing a mere preponderance of probability.
