Difference between wrongful restraint and wrongful confinement?
Wrongful restraint
- Wrongful restraint defined under section 339 of IPC.
- In wrongful restraint of a person is prevented from proceeding in certain direction in which he has right to proceed.
- In wrongful rest and a person is not prevented from proceeding in any other direction except a certain direction.
- A person is compelled to change his path.
- For wrongful restraint it is not always necessary that the offender himself must be physically present.
- Example of wrongful restraint-
A person may be prevented by unloosing a furious dog for the extend threatening to him.
Wrongful confinement
- Wrongful confinement defined under section 340 of IPC.
- In wrongful confinement a person is prevented from proceeding beyond certain circumscribing limits.
- In wrongful confinement a person is prevented from proceeding in any direction beyond certain circumscribing limits.
- A person is totally prevented from proceeding towards any direction.
- For wrongful confinement it is not always necessary for the offender to use his own power.
- Example of wrongful confinement-
To lock the building from outside for placing himself or any other men with firearms at the outlets of the building.
