Draft Order for Cancellation of Warrant
Read application. It is submitted by the Ld. Advocate for the accused that the intention of the accused was not to disobey the summons, but due to sickness of _ABC____he could not remain present on the given date/he was unaware about the summons issued by the court/he was not duly served with the summons. He has assured the Court that, the accused shall henceforth regularly remain present and shall cooperate during the trial. Ultimately, he has submitted to cancel the warrant issued against his client/accused.
It appears from the record that despite services of summons, accused had chosen to remain absent. He had not filed any application seeking exemption/ adjournment on ________, therefore, the court had issued warrant against him. Looking to the grounds of sickness/ non-service of summons and more particularly his assurance to remain present and to cooperate during the trial, warrant issued against him, is hereby, in the interest of justice, cancelled. Accused is directed to execute a bond of Rs.10,000 and a surety of the same amount. With this observation, this application is allowed.
