- It is a bench of supreme court having 5 or more judges to decide he important question of law or fact or to decide any constitutional interpretation.
- According to Article 145(3) of the Constitution matters relating to substantial question of law pertaining to the interpretation of the constitution are to be heard by the bench.
- If president of India needs an opinion related to any question of law or fact which is likely to arise or already arises. Then , constitutional bench can be setup
- If a two or three judge bench doubts the correctness of judgement. and decides to refer the case to a larger bench for a reconsideration of that earlier judgement reconsideration of that earlier judgement.
