Guidelines given by SC para – 33
a. પોલીસ અધિકારી દ્વારા ધરપકડ એ ફક્ત એક વૈધાનિક વિવેક છે જે તેને પુરાવા એકત્રિત કરવાના સ્વરૂપમાં યોગ્ય તપાસ કરવામાં મદદ કરે છે અને તેથી, તેને ફરજિયાત કહેવામાં આવશે નહીં.
b. પરિણામે, પોલીસ અધિકારીએ ઉપરોક્ત કવાયત હાથ ધરતા પહેલા પોતાને પ્રશ્ન પૂછવો જોઈએ કે ધરપકડ જરૂરી છે કે નહીં.
c. ૭ વર્ષ સુધીની કેદની સજાપાત્ર ગુના માટે, ધરપકડ કરવા માટે, BNSS, ૨૦૨૩ ની કલમ ૩૫(૧)(b)(i) ના આદેશ અને BNSS, ૨૦૨૩ ની કલમ ૩૫(૧)(b)(ii) માં ઉલ્લેખિત કોઈપણ શરતો અસ્તિત્વમાં હોવી જોઈએ.
d. BNSS, ૨૦૨૩ ની કલમ ૩૫(૩) હેઠળ આરોપી અથવા સંબંધિત કોઈપણ વ્યક્તિને, ૭ વર્ષ સુધીની કેદની સજાપાત્ર ગુનાઓ માટે નોટિસ નિયમ છે.
e. જો BNSS, 2023 ની કલમ 35(1)(b) હેઠળ ઉલ્લેખિત શરતોના સંદર્ભમાં વ્યક્તિની ધરપકડ માટે જરૂરી સંજોગો ઉપલબ્ધ હોય, તો પણ ધરપકડ કરવામાં આવશે નહીં,
જ્યાં સુધી તે સંપૂર્ણપણે જરૂરી ન હોય.
f. BNSS, 2023 ની કલમ 35(3) હેઠળ જારી કરાયેલ નોટિસ અનુસાર, BNSS, 2023 ની કલમ 35(1)(b) સાથે વાંચવામાં આવતી કલમ 35(6) હેઠળ ધરપકડની સત્તા નિયમિત બાબત નથી, પરંતુ એક અપવાદ છે, અને પોલીસ અધિકારીએ ઉપરોક્ત સત્તાનો ઉપયોગ કરવામાં સતર્ક અને ધીમા રહેવાની અપેક્ષા છે.
Directions :-
33.On the basis of the interpretation given by us, we conclude as follows:
a. An arrest by a police officer is a mere statutory discretion which facilitates him to conduct proper investigation, in the form of collection of evidence and, therefore, shall not be termed as mandatory.
b. Consequently, the police officer shall ask himself the question as to whether an arrest is a necessity or not, before undertaking the said exercise.
c. For effecting an arrest, qua an offence punishable with imprisonment up to 7 years, the mandate of Section 35(1)(b)(i) of the BNSS, 2023 along with any one of the conditions mentioned in Section 35(1)(b)(ii) of the BNSS, 2023 must be in existence.
d. A notice under Section 35(3) of the BNSS, 2023 to an accused or any individual concerned, qua offences punishable with imprisonment up to 7 years, is the rule.
e. Even if the circumstances warranting an arrest of a person are available in terms of the conditions mentioned under Section 35(1)(b) of the BNSS, 2023, the arrest shall not be undertaken,
unless it absolutely warranted.
f. Power of arrest under Section 35(6) read with Section 35(1)(b) of the BNSS, 2023, pursuant to a notice issued under Section 35(3) of the BNSS, 2023 is not a matter of routine, but an exception, and the police officer is expected to be circumspect and slow in exercising the said power.
