1. Appointment

A public prosecutor appointed u/s 24 CrPC is an officer of court. He has to act objectively and not according to dictates of the State Govt. See: Captain Amarinder Singh Vs. Prakash Singh Badal, (2009) 6 SCC 260 (Three-Judge Bench). Para 23 We are also of the opinion that the public prosecutor cannot act on the dictates of the State Government, he has to act objectively as he is also an Officer of the Court.
