- In Warrant Case :- Hear the Accused on the Question of Sentence, If Probation benefit is not given to him,

- Section :- 361:- (S. 6 of P.O.Act) = Mandatory to give special reasons for not giving benefit of probation

- p.o. Act SEc. 6 Age as on date of conviction and not offence to be considered for probation
- 4 Judges - Ramji Missir and Anr. Vs the state of Bihar AIR SC 1088
- Section 363 :- Mandatory to furnish free copy to accused if sentence of imprisonment is awarded.
- Section 389(3) :- Bail By Trial Court to the Person sentenced to imprisonment of not more than 3 years. It is deemed suspension of sentence.
