Difference between rape and adultery?
Rape
- Define under section 375 of IPC.
- This is an offence against the person.
- This offence may be committed against a woman married or unmarried.
- A man commit sexual intercourse with the women against her will or without her consent or with her consent when consent has been obtained by putting her in fair or with a girl who is under 16 years of age.
- A man commits this offence even with his wife when the age of wife is less than 15 year.
- The aggrieved party is women.
- Punishment of rape is life imprisonment or ten year imprisonment and fine.
Adultery
- Adultery defined under section 497 of IPC.
- This is an offence against marriage.
- Such offence can be committed only against of women who is another person’s wife.
- In this sexual intercourse is done with consent of the women.
- This offence cannot be committed by husband against wife.
- The aggrieved party is husband.
- Punishment of adultery is 5 year imprisonment or fine or both.
