Remedies (Hostile Witness)
_ 178th Law Commission report has suggested that statement of the Witness under Section 161 of Cr.P.C. should be signed / thumb impressed by the person giving statement. It should be read out to the witness and copies thereof should be sent to SP / Magistrate.
_ 14th Law Commission Report had suggested that statements of ALL material witnesses taken under Section 161 should also be taken before the Magistrate u/s. 164.
_Similar suggestion had been reiterated by the 177th Law Commission Report. _ Trials should be expedited, frequent adjournments should
not be given.
_ In NHRC v/s. Gujarat (2003 (9) SCALE 329) – Apex Court deprecated government’s attitude of not formulating any law regarding witness protection program.
