I, __ABC___ , have advanced loan on friendly basis to accused on his demand. He had assured me to repay the same within Six Months. He needed the amount for the purpose of his daughter’s marriage/for business purpose/for health issue etc. He being a friend on his demand, I have paid Rs._____to him (accused). At the end of Six months I reminded him to return the money. He has informed me that he has no money on hand. He has issued the cheque of Rs._________with an assurance to me that, the same would be honored on presentation. I deposited the cheque being number_____of________Bank Dated________issued by him (accused) on_______, as per his instruction in the bank in which I maintain my account. To my utter surprise, I received a call and message from the Bank that the cheque deposited by me in my Bank account has been dishonored due to insufficient funds in the account of the issuer. Bank has also handed over return memo to me.
As the cheque amount remained unpaid, I got issued notice through my advocate to the accused on______, by RPAD. The same was duly served to him. Despite service of due notice, the accused has neither paid the cheque amount, nor has replied the notice. I have submitted all the necessary documents along with the complaint, and whatever stated in the complaint is true and correct. I request Your Honor to take necessary steps as per law against the accused.
