Read the complaint. Considered the verification of complainant. Perused the documentary evidence annexed with the complaint. It appears that the complainant is holder of cheque in due course issued by the accused, which he has presented during the validity of the cheque period. The same was dishonored due to insufficient funds. The complainant has issued notice on ______ . The same was received by the accused on _______ . Though the notice has been received by the accused, he has neither replied nor paid the cheque amount. All the ingredients for commission of an offense under section 138 of the Negotiable Instrument Act have been - prima facie - attracted, therefore, following order is passed.

- Issue process to accused under section 204 of code of criminal procedure for alleged offense under section 138 of Negotiable Instrument Act returnable on _________ .
- The Complainant is directed to provide copy of complaint as well as documents.
