Perjury

_ Section 191 of IPC defines Perjury as giving false evidence.

_ Section 193 holds punishment for Perjury as imprisonment that may extend to 7 years.

_ Section 195(1)(b) forbids cognizance of perjury until the complaint is made in writing by concerned court.

_ Another route to deal with perjury is Section 344 of Cr.P.C. – here the court may summarily try a witness for giving false evidence (maximum imprisonment- 3 months; Fine: Rs.500).

Perjury: Seldom use route

_ Though there are provisions of Perjury, it happens to be a seldomused route. Fine on book, not in reality.

_ Moment the court starts using these weapons of law, it will not be too fast to realize that not a single uncontested case will come to the court. Contested cases are time consuming and if the court gets into the business of prosecuting the liars in a heavy pending board, what happens to other matters?
