Difference between common intention and common objects?

  1. Common intention define under Section 34 of IPC.
  2. This section does not create any specific offence.
  3. In order to apply the section at least two person should be there.
  4. Active participation in criminal act is essential.
  5. Priya range plan is an essential feature.
  6. If offence is committed by 1 member in furtherance of common intention that co-accused is also held liable.

Common object

  1. Common object define under section 149 of IPC.
  2. This section create a specific offence.
  3. The main feature of this section is existence of an unlawful assembly. So in order to apply the section at least five person should be there.
  4. Active participation is not essential.
  5. Pre arranged plan is not an essential feature.
  6. If in furtherance of common object offences committed by 1 member each member of the unlawful assembly is held guilty.
